Former Law Minister O. Joy Singh has urged the Governor of Manipur to review appointments made under the Doctrine of Pleasure before the imposition of President’s Rule in the state.
In a memorandum submitted to the Governor, the veteran politician highlighted the Governor’s role during President’s Rule, which was imposed after the state assembly was placed under suspended animation due to the government’s failure to resolve the two-year-long crisis.
O. Joy Singh pointed out that the Advocate General, being appointed under the Doctrine of Pleasure, holds office at the discretion of the government. He argued that such positions cease to continue the moment an elected government becomes non-functional. He further stated that if the principle of appointment under the Doctrine of Pleasure is not followed in the current crisis, it could lead to a constitutional breakdown, irregularities, or complications in governance.
The senior politician emphasized that under settled legal principles, natural justice does not apply in such cases, meaning that incumbents holding positions under this doctrine can be removed without notice if they do not voluntarily resign.
