Directorate of AYUSH warns of strict action against unlicensed manufacture, sale of herbal products

The Directorate of AYUSH, Manipur has warned of strict legal action against individuals and entities involved in the manufacture and sale of AYUSH and herbal products without valid licences, amid growing concerns over unregulated products and misleading advertisements in the alternative medicine sector.
Addressing a press conference at the Directorate office, Director Dr Akoijam Lokendra Singh stated that there would be zero tolerance for violations of licensing norms and advertising regulations. He said strict action would be taken against anyone manufacturing or selling AYUSH or herbal drugs without obtaining a licence from the competent authority.
Dr Akoijam Lokendra Singh informed that both the Supreme Court of India and the Ministry of AYUSH have directed states to ensure strict enforcement of rules governing the manufacture and advertisement of AYUSH and herbal products. The directive, he said, aims to curb misleading claims and safeguard public health.
He stated that misleading advertisements relating to AYUSH drugs, cosmetic products and ophthalmic preparations are punishable under relevant provisions of the Drugs and Cosmetics Act, 1940, and the rules framed thereunder. As per the Act, violation of advertising norms may attract up to six months’ imprisonment or fine, or both, while subsequent offences may lead to imprisonment up to one year or fine, or both.
The Director further disclosed that no licence has been issued so far to any company or manufacturer for the production of AYUSH products in the state. Although several entrepreneurs have submitted applications, he said none has been granted approval due to non-compliance with prescribed norms and regulatory requirements.
Under the Drugs and Cosmetics Act, 1940, manufacturing AYUSH or herbal drugs or opening a pharmacy requires prior licensing approval. Violations can attract imprisonment up to one year or a fine of Rs 20,000, or both. Repeat offences may result in imprisonment up to two years or a fine of Rs 50,000, or both.
Dr Akoijam Lokendra Singh also cautioned individuals and organisations against disseminating misleading information about AYUSH or herbal products through media outlets or social media platforms. While noting that no formal complaints have been received so far, he warned that any violations detected following the press conference would invite immediate legal action.
Appealing to the public, he urged citizens to verify licences before purchasing AYUSH or herbal medicines and to ensure compliance with all applicable legal provisions.
