The teachers who had been under service for more than 30 years or atleast 5 years under the Education(S) Department are eligible for promotion according to Service Rule.
Thus, the then Director, Naorem Praveen on 29th November 2016 under a specific order asked to submit performa including the qualifications. After submission of the list 4 years before and release of different Seniority Lists, former Director Thokchom Kirankumar on 23rd July 2020 released a Final Eligible List of 1903 Graduate Teachers including their names – Graduate Teachers (Arts) – 1097, Graduate Teacher (Science) – 586, Graduate Teacher(Hindi) – 210, Graduate Teacher (Home Science) – 10 and submitted it to the Vigilance Department for Vigilance Clearance.
After working on the process of promotion for a long time, the Manipur Government on 6th August 2020 after a Cabinet Meeting has approved the minimum qualification for the promotion of Graduate Teachers to be B.Ed.Degree . The new rule does not go in compliance with the Recruitment Rule 1995 and 2016. According to Recruitment Rule 2016, a teacher to gain promotion, every Primary Teacher should atleast be at service for 5 years and should hold Bachelor’s Degree. The enforcement of a rule that has not been included in the State Service Rule creates confusion among the teachers. This action has been regarded as very unreasonable and violates the Fundamental Rights of the Teachers and challenges Article 309 of Indian Constitution by the Legislature and Executive.
After struggling for 4/5 years for promotion, the Government is requested not to introduce new Rules that would interfere in the ongoing Promotion Process and also not to take more interest in the Recruitment process before completing the Promotion Process. Even if it becomes necessary to amend Service Rules and the holding of B.Ed Degree for promotion of Graduate teachers necessary, it shouldn’t include those who had already been under the promotion process. The Government shouldn’t ignore the 4/5 years of effort of the teachers and hope that the Government will think about the teachers before taking the decision. If the Government decision violates the Fundamental Rights of the Teachers then the Teachers will fight for the rights through Democratic Procedures.
The teachers’ body urged the authority to do the needful.
