Principal Secretary (Home), Government of Manipur, Dr. Suresh Babu revoked the charges of seizing of Rs 5000 from one Huirongbam Sanatomba as proceeds of terrorism.
In an order served by Principal Secretary (Home), it is mentioned that Huirongbam Sanatomba was apprehended by a team of Imphal West Commando Unit led by ASI Md. Tarique Ali along with another person identified as Thongam Ajitkanta alias Ajit Singh on 13th April, 2012 from Singjamei Mayengbam Leikai near NRL petrol pump. It is said that police recovered one mobile handset from the right side pant pocket of Ajitkanta and two mobile handsets from the left side pant pocket and a sum of Rs. Five thousand from the back side pant pocket of Sanatomba. Police further alleged that seizure amount of Rs. 5000 from Sanatomba as proceeds of terrorism. IO of the case informed the Principal Secretary (Home) Government of Manipur about the attachment of the said amount. A memorandum dated 22nd November, 2014 was issued to Sanatomba giving him an opportunity for making a representation. Sanatomba submitted a representation on December 8, 2014, stating that the said sum of Rs. 5000 alleged to have been seized from his as proceeds of terrorism has already been released by the Hon’ble Court of Judicial Magistrate, First Class, Imphal West by an order date 27th January, 2014. Police Department’s comments on the said representation neither deny the same nor gave a satisfactory clarification on the said allegation.
The reasons and justification given in the representation submitted by Sanatomba that the prayer for confirmation and retention of the seized sum of Rs. 5000 was intimated to Principal Secretary (Home), Government of Manipur by the Investigating Officer on the 3rd February, 2014 when the said sum of Rs.5000 had already been released to him by the Hon’ble Court of Judicial Magistrate, First Class, Imphal.
After examining the report of Investigating Officer and after due consideration of the representation of Sanatomba with judicious mind came to the conclusion that the proposed confirmation of attachment of 5000 as proceeds of terrorism suffers from total non application of mind on the part of the Investigating Officer.
