NHRC issues summon to State Home Secy. over alleged fake encounter case

National Human Rights Commission (NHRC) has issued summons to the Secretary, Home Department, Government of Manipur to appear before the commission to furnish a copy of the final report submitted by the Crime Branch (CB) and also copies of the statements recorded by the Additional District Magistrate Imphal during the Magisterial Enquiry of the alleged fake encounter killing case of Khundrakpam Ibungo @ Priyokumar by combine troop in 2009.
If in case the Secretary Home, Govt. of Manipur fails to comply with the order of the NHRC without lawful excuse, the Secretary Home will be subjected to the consequences of the non-attendance as provided in Rule 10 and Rule 12 of Order XVI of the Code of Civil Procedure 1908. 
The deceased Khundrakpam Ibungo @ Priyokumar, then about 45 years old, was killed along with another person in alleged encounter with the combined troop of 39 Assam Rifles and Imphal West Police commando on the night of October 23, 2009 at Yengoubung area under Lamsang Police station in Imphal West.
Originally the deceased hailed from Thanga Lawai Sabal Leikai but was staying in a quarter of Police Housing Corporation when the alleged encounter happened. Family member told to media persons that he went out of his home in his two wheeler Yamaha motor cycle bearing registration number MNE-1709 along with Rs. 50,000/- cash and some gem stones which he use to trade at around 6 pm of October 23, 2009.
A case was filed to the NHRC by Sh. Subas Chakma, Director, National Campaign for Prevention of Torture, New Delhi to deliver justice to the deceased and his family.
In the summon letter, The Secretary Home Department, Government of Manipur is directed to appear in person before the Commission on October 1, 2015 at 11 am in its office at Manav Adhikar Bhawan, C Block, GPO Complex, INA, New Delhi- 110023 along with the documents and reports sought by the commission . However, if the required documents and the reports are made available to the commission on or before September 24, 2015, then his personal appearance shall stand dispense.
The summons is sent for the second time as the Home Secretary had failed to comply with the directives of the NHRC that was sent earlier too by August 21, 2015.
