Manipur High Court rejects MLA Karam Shyam’s application on Election petition

Ongoing trial of the election petition, to decide on whether the election of Karam Shyam is void or not, is waiting for a final hearing by the Manipur High Court after the Court rejected the application submitted by the Langthabal Assembly Constituency MLA on Thursday. The election petition was filed by Okram Joy Singh.
Okram Joy Singh filed the election Petition challenging the election of Karam Shyam who was elected from 20-Langthabal Assembly Constituency in the 12th Manipur Legislative Assembly Election on various grounds including a false statement in the Form 26 – affidavit submitted along with the nomination paper. In the said form, Karam Shyam had submitted his educational qualification as a Bachelor in Textile Engineering. The petitioner, Okram Joy Singh Challenged Karam Shyam’s election on the ground that he had betrayed the electorate of Langthabal Assembly constituency by submitting false educational qualification.
MLA Karam Shyam later filed an application for rejecting the Election petition filed by Okram Joy on the ground that the said election petition failed to disclose the actual cause of action while filing the same. The miscellaneous application was taken up for hearing and after hearing both the counsel of the parties the order was reserved by the Manipur High Court on August 27, 2023. The Manipur High Court then announced the judgment yesterday rejecting the application of MLA Karam Shyam and the Court ordered for trial of the election petition for a final decision to ascertain whether the election of Karam Shyam is void or not. Learned Counsel H.S. Paonam appeared for the petitioner Okram Joy Singh while learned counsel A. Mohendro appeared for the respondent Karam Shyam.
