Fate of 12 former Parliamentary Secretaries during N. Biren Singh regime to decide on July 26

The fate of the 12 Parliamentary Secretaries who had been appointed during Chief Minister N, Biren Singh Regime is set to be decided on July 26, after the Supreme Court is finally taking up the plea related to the disqualification of the 12 MLAs. The matter is listed on July 26.

Alleging the inability to discharge duty by the Election Commission of India in delivering its constitutional duty, former Minister and MPCC member DD Thaisii filed a plea to the Supreme Court of India.

Manipur High Court had earlier strike down the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Repealing Act 2018 on September 17, 2020.

The Congress party had also moved the matter for disqualifications of the MLAs to the Governor of Manipur Dr. Najma Heptulla putting up the ground that the appointment of Parliamentary Secretary amount to the office of profit. The Governor has sought the view of the Election Commission but there were allegations from the Congress party that no reply has come from the ECI.

Later, after much hue and cry, the Congress party was told that the Election Commission had opined that since the Acts mentioned above were in force at the time they held the office, the MLAs could not be disqualified for holding office of profit retrospectively.
