The Government of Manipur must not delay the issue of Manipur Civil Service combined Competitive (main) Examination, 2016 : Group of Aspirants

The review petition filed by some of the then successful candidates, now Terminated officers, in collusion with the Government of Manipur has been dismissed on dated 17.12.2019 by an order of Special Division of the Hon’ble High Court of Manipur. It is noteworthy to mention that review petition was filed after The special Division Bench of the Hon’ble High Court of Manipur order dated 18.12.2020 and the Hon’ble Supreme Court of India order dated 22.11.2019 quashed MCSCC (main) exam 2016 and order to conduct the MCSCC main exam afresh. The terminated officers and government of Manipur challenged the judgment based on the grounds that sons and daughters of members of inquiry committee has appeared MCSCC Preliminary examination 2016 and accordingly submitted a biased report in their favour. And also, the members of the inquiry committee did not inform The Court of Law and it was against the principle of Natura justice.
It is quite surprised that the sons and daughter of inquiry member committee were not successful in the preliminary examination but inquiry was done on the answer scripts of main examination only. On the other hand, it is quite clear that the orders of The High Court of Manipur and Supreme Court of India directed the MPSC to conduct the main exam afresh. And, therefore, no question of “conflict of interest” arises. Despite that, the committee was formed by an order of date 20.11.2017 by the High Court of Manpur in considering with Counsels of all the involved parties in the matter. And No one challenged with appointment of the said members. Over and above, the validity and correctness of the inquiry committee was questioned by one of the successful candidates before the Hon’ble Supreme court but it was not quashed and set aside by the Supreme Court and on the contrary, the Hon’ble Supreme after perusal of the report in respect of the writ petitioners granted permission to the committee to inspect all the answer sheets including that of the successful candidates. Accordingly, the inquiry committee submitted its final report on 9.7.2018. After this, none of the parties whether government of Manipur and MPSC as well as most of the successful candidates did not complaint. Also, while filing review petition none of the petitioners did not state “any error of the report that shows biased.” Further, the general Public of Manipur also aware of gross illegalities and irregularities revealed by the inquiry committee such as no signature of supervisor in 5764 answer scripts, No signature examiners in 93 answer scripts etc etc. Over and above, a hugr number of illegalities and violation of rules with malafide intention were committed by the MPSC while conducting the said examination and among them mentioned may be made of
1. Conducting the Examination by the Secretary MPSC by taking the charge of Controller of Examination
2. Conducting the examination by the additional secretary MPSC again taking the charge of Controller for 10 days while secretary was out of station.
3. No head examiner in the said examination
4. No instruction or Guidelines was provided to the involved officials including the examiner
5. No moderation and scaling
6. Providing extra answer sheet to some of the candidates violating instruction to the examinations
Considering all these facts, the High Court of Manipur clearly mentioned in its judgement and order dated 18.10.2019 that MCSCCE main examination 2016 was not an examination at all and directed MPSC to quash the said examination and also directed DP government of Manipur to cancel the appointment of candidates selected from these examination. Even after passing this said order, some of the successful candidates and MPSC filed a special leave petitions to the Supreme court of India.After hearing the petitions, the Supreme Court of India observed that Illegalities goes to the root of the matter while conducting these this examination and upheld the High Court Order and directed MPSC to conduct the Main examination at the earliest. Again, to a great surprise the government of Manipur filed review petition inspite of all such illegalities. Further, Group of aspirants would like to ask the government of Manipur whether they will go to the Supreme Court further to defend the matter by wasting maximum resources of the stateand precious time of the candidates. It is also pertinent to mentioned that Group of Aspirants has been pursuing to make a clean and transparent MPSC and to make corruption free recruitment with the help of general public. Group of aspirants further appeal the general public to extend their kind and sympathetic help for the cause. Lastly , the group of aspirants welcome the order of Special division bench of the Hon’ble High of Manipur in this matter.
