CPI condemns the unlawful investigation process on Babysana’s case

CPI members condemned the ongoing investigation process regarding Babysana’s suspicious death in a press meet. Sotinkumar, Secretary CPI, Manipur, said that the ongoing 2-days general strike is called by the JAC to bring out the truth behind the mysterious death and handover the case to CBI, not as a matter of what they desire or without considering the well being of the people. He said that the CM had promised to take up necessary steps and hand over the case to CBI following necessary procedures as soon as possible. Even then, the government has ignored it. Instead of trying to find out the culprit behind this suspicious death, there is an attempt to push the charge towards the family of Babysana. An attempt to compromise the movement can be seen following the arrest of JAC members, crackdown of sit in protests and hunger strikes. CPI condemns such undemocratic behaviour.

Kh. Shamungou, General Secretary of Indian Association of Lawyers, Manipur Chapter, said that they had organised an executive meeting and came up with certain observations. The statement of IGP Clay Khongsai and SP Imphal Meghachandra is pre-judicial and biased based on pre-conceived idea, which is illegal. These 2 police officers said that one of the causes of the death was due to depression as a result of her broken family. According to them, the father has 3 wives and Babysana was brought up by her step mother. As per their statement, Babysana also expressed that it was hard to live and asked for her deceased biological mother to take her. In another account, they said that a rope similar to the one Babysana used was found in her Uncle Ningthoujam Kumar’s residence in Haraorou. As per them, all these could be possible causes of the death.

However, for such a sensitive case investigation, no one, who is not an IO or not from the Special Investigation Team, can interfere or comment on the case as per the law. For the police department and administration, the SP is above the IO, but he has nothing to do with the investigation and cannot make any comments, including the IGP. Until Additional SP, A. Ghanashyam Sharma, who is investigating the case, submits his report to the prosecution through SP, they cannot make any comment to divert the process. Only after his submission, the Director of State prosecution has to submit the report to the court.

One thing that made sense was that they asked the public to not pressurise them during investigation. While they put the blame on the public, they act on a pre-conceived biased idea. Such unlawful act should not be performed. Now, even the family members are not at home. In case if the police wanted to take the father’s statement, they could do it under section 161 at the time when the complaint was made, but they cannot ask for it twice. If they asked to take statements repeatedly, it is unfair on their part. In the name of taking statement, constantly following Babysana’s father looks like an attempt to put him in the list of accused. Indian Association of Lawyers condemns such repressive, unfair, and unlawful investigation.

In the press meet, CPI also expressed worry on the impact that the stripping of 19 lakhs people of Indian Citizenship can have on Manipur. He said that these foreigners may now enter the neighbouring states of Assam. So, the government should take necessary steps to avoid it.

In addition to this, CPI also said that the drought in the state has caused lots of trouble. In a cabinet session, it was decided to announce the drought affected areas, but CPI is not happy with the list of drought affected areas. For instance, Lamlai constituency of Imphal East is an extremely drought-affected area, but it is not on the list.

Communist Party also condemned the decision made on August 31 to privatise Indian Airlines, Jandhan Yojana for the benefit of farmers, but 4 nationalised banks turning into privatised banks, CPI condemns it and will support any movement.

They also condemned the abrogation of Article 370 in Jammu and Kashmir, turning it into an Union Territory. CPI also condemned the decisions taken by Indian government that show the possibilities of interfering with the territorial integrity of Manipur in order to fulfill the wishes of Nagaland. CPI also stated that they will fight against the passing of CAB as mentioned in BJP manifesto.
