Veteran politician and former Law Minister Okram Joy has raised serious constitutional concerns over the continued appointment of Lenin Hijam as Advocate General of Manipur, questioning both his continuation in office and the silence of the Governor on the issue.
Addressing media persons at his residence in Kakwa, Okram Joy stated that Lenin Hijam was appointed as the Advocate General by the previous government led by Chief Minister N. Biren Singh. However, following the resignation of N. Biren Singh on February 9 and the subsequent dissolution of the Council of Ministers, President’s Rule was imposed in the state from February 13 after no party staked claim to form a new government.
Joy argued that under these circumstances, Lenin Hijam’s continuation as Advocate General is unconstitutional. Citing Article 165(3) of the Indian Constitution, he said the Advocate General cannot continue in office in the absence of a popular government or during President’s Rule.
He further remarked that Lenin Hijam, being fully aware of the constitutional provisions, should have stepped down from the post voluntarily. “It is highly questionable how the Governor, reportedly on the recommendation of a resigned Chief Minister, has allowed Lenin Hijam to continue in the post,” Joy added.
The veteran leader said the matter carries serious constitutional and legal implications. He announced his intention to submit a representation to the Union Home Minister, the Solicitor General of India, and the Chief Justice of the High Court of Manipur through their respective Principal Secretaries, seeking necessary clarification and corrective action. Former MLA RK Anand was also present during the press meet.
