The Special Court (ND&PS), Manipur, on Monday granted bail to Phundreimayum Amjad Ali, 33, in connection with a drug seizure case under FIR No. 19(03)2025 of WGI Police Station. The accused was arrested on August 28, 2025, after authorities allegedly recovered 181 bottles of Chlorpheniramine Maleate & Codeine Phosphate Syrup from his possession.
The case, registered under Section 21(b) of the ND&PS Act and Sections 281/125(b)/324(4) of the Bharatiya Nyaya Sanhita (BNS), came up for hearing on April 4 and April 7, 2025.
While opposing the bail plea, the Special Public Prosecutor, Moirangthem Raichand, contended that the accused was part of a drug trafficking network and that releasing him could hinder the ongoing investigation, particularly since his alleged associates remained untraced.
However, defense counsel Ch. Victor argued that the accused was handed over to the police by a mob, raising questions about the legality of the seizure. He also pointed out that the seized substances were allegedly expired. Importantly, he cited humanitarian grounds for bail, informing the court that the accused’s wife had recently undergone a renal transplant and required follow-up treatment at MAX Hospital, Chandigarh. He submitted medical documents and affidavits showing that she was physically unfit to travel alone with their two minor children.
After considering the submissions, the court observed that the quantity of the alleged contraband fell under the “intermediate” category, thus not attracting the stringent bail conditions under Section 37 of the ND&PS Act. Judge Mona Lisa Maibam ruled that the interest of justice would be served by granting bail.
Accordingly, the court allowed the bail application and ordered the release of Amjad Ali on furnishing a personal recognizance bond of Rs.10,00,000 with two government employee sureties of like amount. The accused was directed to cooperate with the investigation, refrain from tampering with evidence or witnesses, avoid committing similar offences while on bail, seek prior court permission to leave the state, and appear before the court as required.
The matter has been disposed of with the bail granted.
