Misuse of position by Govt. employee reveals while applying for anticipatory bail

The Additional Session Judge (FTC) Manipur East has finally granted anticipatory bail to the proprietor of the M/s Avian House. What is interesting is the revelation of a few governments servant misusing their position and finally harassing the entrepreneur using certain provisions of law by not explaining it properly to the aggrieved person, in the order passed by the Additional Session Judge (FTC) Manipur East on April 4, 2023.
The anticipatory bail plea was applied by the counsel of Chongtham Dhurvatara Khaba (42) , a resident of Khonghampat Awang Leikai under Sekmai Police Station after one Government employee, serving as Motor vehicle officer in the Motor Vehicle Department, Govt. of Manipur filed an FIR under section 353/500/34 of the Indian Penal Code at the Sekmai Police Station. During the last 7 days, the counsel of Chongtham Dhurvatara Khaba had applied bail plea twice but turn down by the court. However, the third plea had been listened to by the Additional Session Judge who finally granted pre-arrest bail (anticipatory) bail to Chongtham Dhurvatara Khaba.
The court of the Additional Session Judge, Manipur East has ordered to release him on bail on his event of being arrested in connection with the FIR on furnishing a bail bond and surety bond of Rs 50,000/- each to the satisfaction of the OC, Sekmai P.S. on the condition that the petitioner does not leave the country without the permission of the court and also to -co-operate in the investigation in connection with the case.
In the court order, it has also come to the notice that the vehicle used by Transport Officer Yumnam Pritam Singh, who is also the complainant of the case against Chongtham Dhurvatara Khaba, has been found using expired vehicle insurance.
“Yumkham Pritam Singh while trying to evade the present petitioner was driving a vehicle Motor Car Gypsy registered in his name bearing Regd No. MNO1AG2323 wherein the vehicle insurance had expired on 12th March 2022”, the court order mentioned.
