CEC assures Congress MLA to act as per the constitution of India on PS case

Imphal, March 16: Chief Election Commissioner of India today assured to take up matter of the Parliamentary secretaries as per provision of the constitution of India. This was stated to Imphal Times by a Congress MLA who met with the CEC today morning at Nirvachan Sadan, New Delhi.
Eleven Congress MLAs including former Chief Minister Okram Ibobi, G, Gaikhangam, Govindas Konthoujam, Khumukcham Joykishan, O Surjakumar, Th. Lokeshwar, K. Ranjit, K. Meghachandra, O Henry , Kh. Loken today met the CEC Om Prakash Rawat at New Delhi.
The Congress MLA said that the CEC had assured necessary procedures as per the constitution of India.
On Thursday, the Supreme Court held that the legislature cannot overrule judgments by amending a law retrospectively, saying this will amount to violation of the principle of separation of powers among the three organs of the state, which is impermissible.
Sending out a clear message to law-making bodies — Parliament and assemblies — that judicial pronouncements must be respected, a bench of Justices Madan B Lokur and Deepak Gupta said they were entitled to amend the law to remove defects pointed out in a judicial order but the new law could not be implemented retrospectively as it would amount to nullifying the judgment.
This comes in the aftermath of the passing of the Parliamentary Secretary Repeal Bill. The Bill is yet to be consented by the Governor of Manipur.
