If a person throws stone to Shops , should we wait for the magistrate to prove or should the police act? – MU Community

While stating that the core objective of Education is the search for truth and the means to arrive at the truth, The Manipur University community who has been on strike for over 55 days today stated that they are fully committee to this exemplary example.
In a statement signed by Presidents of MUSU, MUTA and MUSA, it is stated that if a person throw stones to a shop at Paona Bazar and cause damage, is it right to wait for the magistrate to arrive and give judgment that whether the person is throwing stone to the shop?
This comes as a reply to those protagonists who are talking about ‘natural justice’ in connection with the unstinted demand for removal of AP Pandey from his VC post of Manipur University.
“ Talking about natural justice in the present context of Manipur University is no different from inviting the magistrate before security forces arrest the person causing damages to the shops.
The Manipur University Community is still firm on the demand for removal of the present VC AP Pandey, from his position coupled by an Independent enquiry to his financial and administrative misdeed to establish accountability and generate lessons for posterity, the statement added.
Pointing out the irregularities and damage cause by the VC AP Pandey, the statement said that the VC is still not at his station of his posting , he left Imphal on July 25, 2018.
“True to his habit the date of his return is unspecified. Even more he left station without handing over the charge to anybody in the University.
AP Pandey in his clarification stated that there is no mandatory requirement , as per the Manipur University Act 2005 to hold meetings of the Executive Council and the Finance Committee minimum of 3 times a year. But the Article 13 (3) of the Manipur University Act 2005b writes that the VC may , if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority at its next meeting the action taken by him on such matter.
In Article 22 (2) it is also stated that “ Subject to the provisions of this Act , the Court shall have the following powers and Function :- a) to review , from time to time , the broad policies and programmes of the University and to suggest measures for the improvement and development of the University; b) to consider and pass resolutions on the annual report on such accounts.
Article 18 (5) says that the finance Committee shall meet at least thrice every year to examine the account and to scrutinize proposals for expenditures.
The statement also stated that Prof AP Pandey not only indulges in continual violation of the Constitution Norms but also put in writing in the public domain that he does not have to follow these.
“Does not the open and profuse violation of the constitution demand immediate impeachment?” the MU Community question.
