Loophole noted; something needs to be added at RP act

After the Manipur High Court has order the election of Y Surchandra from Kakching Assembly constituency in the 11th Manipur Legislative Assembly as null and void, BJP Candidate who M. Rameshwor has been elected as the MLA and has taken oath as member of the Manipur Legislative Assembly today.
Except for the declaration of the election of Y. Surchandra as null and void and giving verdict to elect M Rameshwor as the MLA of Kakching Assembly constituency, nothing about the penalty that may be awarded to Y. Surchandra has been mentioned.
This write up is not about who is wrong or who is right or has nothing to do with the verdict. The High Court ruling was purely base on the Representative of the People’s act and as per the law of the land.
But question arises is that- for 3 years and some months Y Surchandra has enjoyed all beneficiaries including the salary of being MLA. If the election that he was elected is null and void than those salary and allowances he enjoyed during the 3 years and some months is a spoil of public money. On the other hand after the High Court as ordered the election null and void and order to elect M Rameshwor as the MLA, what about his rights of the period when Surchandra was considered as the MLA. He might have been facing lot of humiliation and suffering during those days. However, nothing of such – whether the salary Surchandra enjoyed should be repay back or whether the new MLA Rameshwor should be compensated about his lost repuration has been mention at the Representative of the people’s Act. In the ruling of the Manipur High Court too nothing of such has been mentioned on whether there should be a penalty to Surchandra or whether there should be a compensation to Rameshwor has been mentioned.
Perhaps there are certain things that has to be added to the Representative of the peoples’ act about the matters on what should be done to the candidate whose election has been declared null and void.
