The Check and Balance in Indian Democracy

With the ruling of the Manipur High Court today in connection with the miscellaneous petition filed against the 7 congress MLAs who have defected the Congress party and unofficially joined the ruling BJP, the congress party have almost reached the endpoint in reaching their goal. But it is not sure in assuming whether the Congress party is positioning in the upper hand in the game of politics or is it a mere victory that will have no significance is matter that need to be ponder upon.
Well, there has been many sessions witness in the 11 Manipur Legislative Assembly and since the beginning of the session of this 11th Manipur Assembly, the house was never in order with MLA who won in the Congress Party seat sitting with the ruling party as Minister and latter, the 7 Congress MLAs supporting the BJP by sitting in the opposition bench. The so called seven congress MLAs have declared to have joined the ruling BJP. And there were photos in various media showing their picture of joining the BJP, however, the unfortunate part of the 11th Manipur Legislative is that the 7 Congress MLAs who had declared to have joined the BJP are officially recorded as Congress MLAs in the Manipur Legislative Assembly.
There were severe criticisms to the way of the Manipur Legislative Assembly terming it as a direct threat to the Constitution of India.
The span of the 11th Manipur Legislative Assembly is just about 1 years and 8 months to go and it is only at this moment that the face of the democracy is slowly turning to the right direction. After Shyamkuamr’s disqualification, it is likely that the fate of Shyamkumar is met to all the other 7 Congress MLAs. However, will the disqualification of the defected Congress MLAs a victory for the Congress party? A matter, that needs to be discussed.
First the aimed of the Congress party was to topple the BJP led government. This will not happen as the BJP still hold the number even assuming that the 7 MLAs are disqualified. Second, the Congress party may have plan of winning the RS seat, which is also not possible as at the moment. In both case the Congress defeats. Saying so if the motives of the Congress party is solely to save the Democracy as per the constitution of India then the Congress Party win.
Whatever be the motive, the attempt by congress party as opposition, and the case filed against the defected MLAs under the 10th Scheduled of the Indian Constitution is the revelation about the existence of check and balance system to the working of the Indian Constitution. The autocratic nature of any government in the power is checked with the existing provisions under the law of the country even as there are rumours about the judiciary being controlled by those in the government. The beauty of the Indian Constitution finally is shown with the series of events in the political theatre of Manipur. As for those MLAs who are going to face the music they should now admit that they are not liable to be representative of the people. If in case they don’t accept they mistake then people should teach them lesson.
